Abstract: The aim of enacting legislation by rural collective economic organizations is to solve relevant problems and the establishment and operation of rural collective economic organizations have special features. In such organizations, farmers are the owners of the land, and the land is collectively owned by farmers. The goal of the organizations is to solve the problems of farmers, promote mutual assistance and cooperation among them, bring benefits to them, and adhere to the principle of distribution according to labor. Besides, rural collective economic organizations undergo different changes in various periods. As the national development has entered a new era, it is necessary for us to pay more attention to the definition and protection of farmers through constant innovations. By so doing could we adapt to the changes in the rural population and the need to make good use of rural land in line with the complex social relations in rural areas and the need to resolve social conflicts. According to the transformation of rural development mode, we need to activate the enthusiasm of farmers as special legal persons. The policy options on enacting relevant legislation are as follows. The nature of the members of rural collective organizations needs be defined as laborers, focusing on rendering service to farmers; the mode of operation of the organizations needs to be specific, emphasizing their practice with a sound order; the development of the organizations needs to be classified, with emphasis laid on positive incentive mechanism.
